Slip and Fall Accidents

Some people think that the slip and fall accident is one of the most basic torts to litigate successfully. Undoubtedly, this is incorrect. Slip and fall accidents are among the most difficult torts to litigate because the problem is most likely transient.

It is not hard to imagine in an icy winter situation that a person coming out a restaurant with a few steps by the door might lose his or her balance on the steps and end up falling. This fall could result in an injury. The cause of the fall could have been simply tripping or it might be due to the ice found on the steps at the time the individual was coming out of the restaurant.

If the fall was due to the ice on the steps and on the handrail, it is likely that no one will think to photograph the ice on the steps and the handrail at the time of the accident. This is because, if the individual is seriously hurt, the focus is on making the now injured patron of the restaurant comfortable and getting him or her to a doctor.

By the time anyone thinks that the ice needs to be photographed, it could have melted or could have been removed by the restaurant, noticing finally that the stairs need attention. This makes proving the cause of the accident very difficult, since there is no proof. Any witnesses to the fall might not have noticed any ice either, particularly if there was just one patch of it.

The same problems arise in almost all slip and fall cases, regardless of whether the lack of traction is due to spilled water, motor oil, or ice.
