Family awarded $1.3 million in brachial plexus injury lawsuit

A couple from Cedar Falls, Iowa was recently awarded $1.3 million in a brachial plexus birth injury lawsuit filed against a doctor that aided in their daughter’s birth.

According to the lawsuit, during their daughter’s delivery in November 2006, the doctor failed to recognize that the infant’s shoulder was caught in the birth canal.  Furthermore, the doctor was accused of using “excessive traction” to aid in the delivery.

When an infant’s shoulder becomes caught in the birth canal, the brachial plexus nerves in the shoulder are damaged.  This nerve damage can have serious and permanent complications like Erb’s Palsy.

The young girl involved in the lawsuit did develop Erb’s Palsy as the result of the brachial plexus injury and has limited use of her left arm.  The girl needs frequent physical therapy to keep the condition from worsening.

Mother awarded $21.6 million in birth injury suit

A jury in Erie County recently ordered UPMC Hamot to pay $21.6 million to a Pennsylvania mother who filed a birth injury lawsuit against the hospital.

The lawsuit claimed that the hospital’s nursing staff was not properly trained or prepared to handle the complications that arose while the mother was in labor.  Nurses did not do what was necessary to help prevent oxygen deprivation to the boy.  He is now 4-years old and unable to speak or feed himself.

The verdict specified $19.6 million of the money was to pay for the boy’s future medical expenses.  The difference was granted for past medical expenses and loss of earning capacity.
