Case settled over pedestrian injuries for $335,000

A case filed by a 56-year-old truck driver working at a cemetery in New York was recently settled for $335,000. The lawsuit was filed against the cemetery and its operators, the trustees of Calvary Cemetery and the Archdiocese of New York.
The plaintiff was injured while off-loading a delivery of dirt at the cemetery in 2006. His truck, which was being directed by an employee of the cemetery, struck him. The accident caused the worker to suffer a fracture to his left clavicle, fractures to four ribs, and a tear to a tendon in his left shoulder.
According to the lawsuit, the cemetery’s employee told the truck driver to park the truck in an area where the soil was not able to support the vehicle. Experts supported this argument.
After the accident, the plaintiff was determined to have a permanent partial disability. In the case’s settlement, the Archdiocese of New York agreed to pay the worker $335,000.
