Posted on April 6th, 2011 No Comments

A California woman has filed a slip and fall lawsuit against a Pasadena Walmart.

According to Harris County District Court documents, Pasadena-resident Nora Hernandez filed a lawsuit on March 30 against Wal-Mart Stores. The lawsuit alleges the store’s employees allowed a substantial amount of water to pool on the floor, which caused Hernandez to slip and fall.

According to the lawsuit, Hernandez claims she was seriously injured while shopping at Walmart store no. 2724, located at 1107 Shaver St. in Pasadena. The brief states a pregnant Hernandez slipped and fell on water that had gathered on the store floor, injuring her back, knee, and abdomen.

Hernandez is asking the court for actual damages plus court costs.

A spokesman for Walmart declined to comment on the lawsuit.

Widow of Oil Rig Crewman Settles Lawsuit Against BP

Posted on March 15th, 2011 No Comments

The widow of one of the 11 crew members who died in the April 20 explosion of the Deppwater Horizon drilling rig has settled her wrongful death lawsuit against BP Plc.

According to court documents, United States District Judge Carl Barbier of New Orleans agreed to dismiss Melinda Anne Becnel’s lawsuit against BP. The company hired the Deepwater Horizon rig to drill a subsea well that exploded off the Louisiana coast last year, causing the worst marine oil spill in U.S. history. Becnel’s husband, Keith Blair Manuel, was one of eleven men killed in the explosion.

Becnel’s claims against BP’s partners in the well and other oilfield contractors involved in the project were also dismissed. Transocean Ltd, owner of the Deepwater Horizon, was not a party to the lawsuit.

BP and the other companies involved in the spill face more than 350 lawsuits from individuals and businesses claiming economic and personal injury from the explosion and spill.

The terms of Becnel’s settlement were not disclosed.

IKEA Recalls 26,000 Defective Cribs

Posted on February 22nd, 2011 No Comments

IKEA has announced a voluntary recall Thursday of more than 26,000 cribs which could entrap and suffocate children if the mattress support detaches.

According to a joint statement released by the United States Consumer Product Safety Commission and Health Canada, four of the bolts provided to secure the mattress support on IKEA SNIGLAR brand cribs are not long enough and may collapse. Neither agency has received any reports of incidents involving the cribs but parents are urged to check if the mattress support bolts extend through the nut. Consumers can contact IKEA for a free repair kit, the statement said.

About 20,000 of the non-drop-side, full-size cribs were sold in the United States and around 6,000 in Canada. The cribs were sold from October 2005 through June 2010 at IKEA stores throughout North America.

Crib-related accidents send 26 children to emergency rooms each day in the United States and result in more than 110 deaths annually.

Michigan City Settles Sidewalk Slip and Fall Lawsuit

Posted on February 9th, 2011 No Comments

A city in Michigan has agreed to pay more than $49,000  in a slip and fall lawsuit filed by a woman who broke her foot after tripping on a residential sidewalk.

The city of Royal Oak, Michigan said terms of the settlement does not include an admission of guilt. Royal Oak officials said the payment is being made to “preserve good will, avoid continued litigation, and make financial compromise.”

According to Oakland County Circuit Court documents, 79 year-old Margaret Malinasky says she tripped on a raised portion of sidewalk in July 2007, breaking two toes and displacing four others. Malinasky was carrying her infant granddaughter at the time. The lawsuit claims the city was negligent in maintaining a public sidewalk.

A case evaluation panel previously awarded Malinasky $83,000. The city took the case to trial, claiming governmental immunity.
