Waitress who tripped over cord files slip and fall suit

A waitress working who tripped over an electric cord used by two unlicensed electricians recently filed suit against the electricians’ employer.

According to the premises liability lawsuit, the 48-year old waitress was injured at her job in Texas in March of 2007.  The electricians were certified to work in Florida, but not Texas.  However, their employer, Bright Future Electric LLC, still sent the two workers to change an electrical wire on an oven at the restaurant.

The plaintiff argued that Bright Future Electric was liable for her injuries because they created the dangerous situation and did not implement any warnings to help workers notice and avoid the electrical cord.

The defense argued that the restaurant was responsible for hiring them for the job.  However, evidence was insufficient to implicate the restaurant in the case and the jury awarded the woman $423,386.10.

In the accident, the woman suffered a torn anterior cruciate ligament and a broken fibula.  An athroscopic resconstructive surgery was necessary after the slip and fall accident.
