A judge in Philadelphia sentenced a Ephrata man to prison for a hit-and-run crash that critically injured a Temple University student in April.

According to Philadelphia Common Pleas Court records, Judge Harold M. Kane sentenced Nicholas Hasselback Monday to three to six years in prison. Hasselback pleased guilty October 1 to aggravated assault and leaving the scene of an accident in connection with an April 11 crash on Benjamin Franklin Parkway.

The accident left 25 year-old Tony Foltz critically injured. Foltz was walking along the parkway shortly after 2:00 a.m. that night when he was struck by a white Subaru that did not stop, according to police. An anonymous tip led authorities to Hasselback.

Foltz sustained severe brain injuries and multiple broken bones. He underwent five surgeries and spent months in rehabilitation before resuming his law studies at Temple University.

Philadelphia Woman Files Lawsuit Over Sept. Megabus Crash

Posted on October 20th, 2010 No Comments

A Philadelphia woman has filed a personal injury lawsuit after suffering head injuries last month in a bus crash that killed four people.

According to the lawsuit, 26 year-old Candice Burks, of Mount Laurel, was one of the 28 passengers aboard a double-decker Megabus traveling from Philadelphia to Toronto on September 11. Around 2:30 a.m., bus driver John Tomaszewski missed an exit to the Syracuse bus station and doubled back, police say. Tomaszewski was looking at a personal GPS device when he drove the 13-foot-high bus into a railroad bridge with an 11-foot clearance, according to the accident report.

About a dozen signs and flashing yellow lights lead up to the bridge, warning drivers of the height restrictions, police say.

Burks sustained head, neck, and bak injuries in the crash. Her attorney, Shanin Specter, said the accident left her client with “significant cognitive impairments,” including problems with attention and memory.  “When you have a bus going at full speed and it just stops on a dime like that, you’re going to have people who are badly injured,” Specter said.

A number of other passengers suffered injuries in the crash. “The full extent of their injuries won’t be known until later,” Specter said. “Brain injuries and impairments can last for a lifetime and you just don’t know after an accident how a person could end up.”

In the lawsuit, filed Friday in Common Pleas Court, Burks is seeking more than $50,000 in damages. It is believed to be the first lawsuit stemming from the crash.
